This Privacy Policy informs you about what personal data we collect via kwatalecollection.com, how we use it and what rights you have. It is based on the Swiss Federal Act on Data Protection (DSG) and – insofar as visitors from the EU/EEA are concerned – on the General Data Protection Regulation (GDPR). It supplements the General Terms and Conditions (GTC) of Kwatale GmbH, of which it forms an integral part in accordance with clause 13 of the GTC.

2. What Data We Process

Contact and booking details: name, address, email address, telephone number, travel dates, number of people, special requests (e.g. dietary requirements, health information) that you provide to us via the booking or contact form.

  • Newsletter data: email address and, where applicable, name, if you subscribe to our newsletter.
  • Payment information: billing details required for processing the deposit and final payment. Credit card or bank details are not stored on our website but are processed directly via the relevant payment service provider or by bank transfer..
  • Usage data: technical data generated when you visit the website (e.g. IP address, browser type, operating system, pages visited, duration of visit), which is automatically collected via server log files and, where applicable, analytics tools.
  • Cookies and similar technologies: see section 6.

Data relating to minors: Where data relating to minor travelling companions (e.g. age, health information) is provided as part of a booking, this may only be submitted by their parents or legal guardians. Minors are not permitted to submit such data themselves.

3. Purposes of Processing

  • Processing and confirmation of booking enquiries, as well as contract fulfilment (including communication before, during and after the stay).
  • Sending information, offers and news, provided you have subscribed to the newsletter.
  • Sending information and offers to existing or former guests, based on our legitimate interest in customer care (Article 6(1)(f) of the GDPR or Article 3 of the Swiss Unfair Competition Act); you may object to this use at any time.
  • Ensuring the technical operation, security and further development of the website.
  • Compliance with statutory retention and record-keeping obligations (e.g. accounting requirements).
  • Asserting or defending legal claims.

4. Legal Bases

Where the GDPR applies, the processing of your personal data is based on the following legal bases:

  • Performance of a contract or pre-contractual measures (Article 6(1)(b) of the GDPR) – for the processing of your booking and stay.
  • Consent (Article 6(1)(a) of the GDPR) – for sending the newsletter.
  • Legitimate interests (Article 6(1)(f) of the GDPR) – for the secure and functional operation of the website, as well as for direct marketing to existing or former guests (see section 3); in Switzerland pursuant to Art. 3 of the Unfair Competition Act (UWG).
  • Compliance with legal obligations (Art. 6(1)(c) GDPR) – e.g. for statutory retention obligations.
  • Explicit consent for special categories of personal data (Article 9(2)(a) of the GDPR and Article 34(2)(a) of the DSG) – for health-related information that you provide to us, for example, as part of your booking (see section 2).

Under Swiss law (DSG), the processing of data is also governed by the principles of proportionality, purpose limitation and transparency.

5. Disclosure of Data

We will only disclose your data to the extent necessary for the performance of the contract or where you have given your consent, namely to:

  • local partner companies and guides in Botswana for the preparation and execution of your stay;
  • travel agencies or tour operators commissioned by us, provided the booking was made through them;
  • technical service providers, e.g. for website hosting, email dispatch or booking software, who support us within the framework of a data processing agreement;
  • public authorities, where there is a legal obligation to provide information.
  • Your data may also be processed in Botswana and in other countries outside Switzerland and the EU/EEA. Where an adequate level of data protection does not exist, we ensure the protection of your data through appropriate measures, namely through contractual safeguards (e.g. standard contractual clauses) with the respective recipients.

6. Cookies and Analytics Tools

Our website uses cookies and similar technologies to ensure functionality, improve your user experience and analyse website usage statistically. We distinguish between technically necessary cookies, which are required for the website to function, and optional cookies (e.g. for analytics or marketing), which are only set with your consent via our cookie banner. You can withdraw your consent at any time with future effect via the website’s cookie settings, and you can also manage or delete cookies in your browser in general.

7. Retention Period

We process and store your personal data only for as long as is necessary to fulfil the stated purposes or in accordance with statutory retention obligations (e.g. commercial and tax law requirements, which generally stipulate a ten-year retention period for accounting-related documents). We process newsletter data until you unsubscribe.

In accordance with applicable law (the Data Protection Act or the GDPR), you have the following rights in particular:

  • Access to the personal data we process;

  • ·  Erasure of your data, provided that no statutory retention obligations prevent this;

  • ·  Objection to processing, where this is based on legitimate interests;
  • ·  Lodging a complaint with the competent supervisory authority (in Switzerland: the Federal Data Protection and Information Commissioner (FDPIC); in the EU: the data protection authority in your country of residence).

We take appropriate technical and organisational measures to protect your data from unauthorised access, loss or misuse. Data transmission via our website is encrypted (SSL/TLS).

Our website may contain links to third-party services (e.g. social media channels, embedded maps or booking tools). Data processing by these third-party providers is governed by their own privacy policies; we have no influence over their data processing.

11. Changes to this Privacy Policy

We will update this Privacy Policy whenever changes to the website, new technologies or legal requirements so necessitate. The version published at the time of your visit to the website shall apply
