General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (hereinafter ‘GTC’) apply to all bookings and stays at the Kwatale Collection on Concession NG43, Greater Moremi, Botswana, made via the website kwatalecollection.com, by email or by any other means directly with Kwatale GmbH or a sales partner authorised by it (travel agency, tour operator). By making a booking, the person making the booking (hereinafter referred to as the ‘Guest’) agrees to these GTC. Any deviating terms and conditions put forward by the Guest shall not form part of the contract unless Kwatale GmbH expressly agrees to their validity in writing.

2. Contracting Party

The contracting party is Kwatale GmbH, Dorfstrasse 2c, 8835 Feusisberg, Switzerland (Commercial Register of the Canton of Schwyz, CHE-132.666.770), hereinafter referred to as ‘Kwatale’ or ‘we’. The on-site operational delivery – including the camps, guided activities and other services within the Kwatale Collection offering – is carried out by local partner companies in Botswana on behalf of Kwatale GmbH.

3. Booking and Conclusion of Contract

A booking enquiry made via the website or by email constitutes a non-binding offer by the guest. The contract is only concluded upon written confirmation of the booking by Kwatale. We usually confirm booking enquiries within two working days. Any amendments or additions to the contract must be made in writing (email is sufficient).

4. Prices and Scope of Services

The prices per person per night (rack rate) stated in the quotation or booking confirmation apply. Prices are shown on the website and in quotations in US dollars (USD), euros (EUR) and Swiss francs (CHF). The currency specified as the reference currency in the individual booking confirmation is decisive for the fulfilment of the contract; the amounts in the other currencies are for guidance only and are converted at the current exchange rate, which is why minor, exchange-rate-related variations are possible. The scope of services (e.g. full board, activities, internal transfers, drinks) is set out in the individual quotation or booking confirmation. Services not expressly included – namely international flights, visas, travel insurance, personal expenses, tips and optional additional activities – are to be borne by the guest. Kwatale reserves the right to adjust prices for stays that have not yet been booked at any time; for bookings that have already been confirmed, the prices agreed at the time of confirmation apply.

5. Terms of Payment

  • Deposit: To secure the booking, a deposit of 50% of the total price is due within 14 days of receiving the booking confirmation.
  • Balance: The balance must be paid no later than 60 days before arrival.
  • Last-minute bookings: For bookings made within 60 days of arrival, the full tour price is due immediately.
  • Late payment entitles Kwatale to withdraw from the contract and to charge the cancellation fees set out in clause 6.

Unless otherwise agreed, all payments shall be made by bank transfer to the account specified in the booking confirmation, either in USD, EUR or CHF, in accordance with the reference currency specified therein. Bank charges and any exchange rate differences shall be borne by the guest.

6. Withdrawal and Cancellation by the Guest

In the event of withdrawal by the guest, unless otherwise agreed in the individual booking confirmation, the following cancellation fees, expressed as a percentage of the total price, shall apply:

  • Up to 90 days before arrival: Refund of the deposit less a 10% administration fee.
  • 89–60 days before arrival: 50 per cent of the total price.
  • 59–30 days before arrival: 75 per cent of the total price.
  • Less than 30 days before arrival or failure to arrive (no-show): 100 per cent of the total price.

The date on which Kwatale receives the written notice of cancellation shall be decisive. We strongly recommend that guests take out travel and cancellation insurance, as the aforementioned time limits and rates apply regardless of the reason for cancellation.

7. Cancellation or Changes by Kwatale

Kwatale is entitled to cancel or postpone a confirmed stay for good cause – in particular in the event of force majeure, official orders, security risks or circumstances that seriously impair the operation of the camp (see clause 9). In this case, the guest will, where possible, be offered an equivalent alternative (alternative date, comparable accommodation). If the guest does not accept this, any payments already made will be refunded in full; any further claims by the guest, in particular for compensation for consequential costs (e.g. flights), are excluded.

8. Conduct at the Camp and During Safari Activities

A stay at the Kwatale Collection takes place in an undeveloped wilderness area with wild animals living in the wild. The guest undertakes to strictly follow the instructions of the guides and camp staff at all times. Activities such as game drives, guided walks (walking safaris) and boat trips take place exclusively under the supervision of trained guides. Kwatale may adjust, postpone or cancel individual activities at short notice for safety, weather or conservation reasons; there is no entitlement to the performance of a specific activity at a specific time.

9. Liability

A stay in an African game reserve involves inherent risks which cannot be completely ruled out even when all safety precautions are observed, namely contact with wild animals, rough terrain, weather conditions and limited local medical facilities. Guests take part in all activities at their own risk and, by making a booking, confirm that they are physically fit to undertake the booked activities.

Kwatale shall only be liable for damages in cases of wilful misconduct or gross negligence on the part of its officers, employees or authorised third parties. Liability for slight negligence, as well as for indirect damages, consequential damages or loss of profit, is excluded to the extent permitted by law. No liability is accepted for the loss of or damage to the guest’s personal belongings, unless this is due to gross negligence on the part of Kwatale. Guests are strongly advised to take out suitable travel, accident and repatriation insurance (including evacuation costs, e.g. via Flying Doctors/AMREF), and in some cases this is a prerequisite for travel.

10. Force Majeure

Force majeure includes, in particular, natural disasters, epidemics/pandemics, border closures, states of war or civil unrest, official orders and comparable extraordinary events for which Kwatale is not responsible. In such cases, both parties are entitled to withdraw from the contract; payments already made will be refunded, less any non-recoverable costs already incurred (e.g. advance payments to third parties), or credited at the guest’s discretion.

11. Travel Documents, Health and Entry

Guests are personally responsible for ensuring they hold valid travel documents (passport, visa), for complying with the entry requirements of Botswana and any transit countries, and for meeting any health-related entry requirements (e.g. vaccinations). Kwatale provides non-binding information on known requirements but accepts no liability in this regard. It is the guest’s responsibility to obtain information from the relevant embassies or consulates in good time before arrival.

12. Children and Families

Kwatale Collection welcomes families; for certain activities (e.g. walking safaris), age-related minimum requirements may apply, which will be specified in the individual quotation. Parents or legal guardians are responsible for supervising their children at the camp and during all activities.

For activities involving increased risk (e.g. walking safaris, boat trips, night drives), parents or legal guardians confirm upon booking that they are aware of the associated risks for the accompanying child and authorise participation at their own risk. Kwatale may require that this declaration of consent be confirmed in writing on site (e.g. using a separate form); participation in the relevant activity may be made conditional upon this confirmation.

13. Data Protection

The processing of personal data in connection with a booking is governed by our separate Privacy Policy, which forms an integral part of these General Terms and Conditions..

14. Applicable Law and Jurisdiction

These General Terms and Conditions, as well as all legal relationships between the guest and Kwatale, are governed by Swiss substantive law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-laws rules of private international law. The exclusive place of jurisdiction is the registered office of Kwatale GmbH in the canton of Schwyz. Mandatory provisions of consumer protection law at the guest’s place of residence remain reserved.

15. Final provisions

Should any individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision. Kwatale may amend these General Terms and Conditions at any time with effect for future bookings; for bookings that have already been confirmed, the General Terms and Conditions valid at the time of the booking confirmation shall apply.
